After looking into it more, if the sump pump failed because of being swamped by the storm, you're liable.  If you can prove it was faulty before hand and he had knowledge of it, go after the property owner.

Wouldn't that be the responsibility of his insurer, as to reclaim loss after a payout?

Insurance called back said I am SOL, holding it together is very difficult right now

that's fucking ridiculous. What's the point of insurance if they don't cover anything.

Im not certain starting a fight with the person who is

A) Living above me
B) Has been really good about this so far

Neither of which matters. You do not have a friendship with this guy, you have a business relationship. Don't let him roll over you just because he's "been good about it" so far. Make sure he holds up his end of the bargain. Hell, get a lawyer to review your lease and insurance policy.

True, the latter will be first, reviewing and discussing the insurance policy. Followed by the lease.

I know at least I can't be charged while I cant occupy the place and its on them to make it livable, which will mean replacing all the drywall, cleaning the floors, replacing the major appliances (stove, fridge, dishwasher, washer/dryer). Might pay or some other things as well, but I *do* know as far as things destroyed in the flood I am not covered.

The analogy Crow speaks to, lets say the circuit breaker starts a fire, total loss, I get jack and shit. Their insurance only covers the building and all of my stuff is on me, though I would suppose barring shitty maintenance, and in a case like this it would be a difficult thing to prove.
Suddenly my raise freeze this year doesn't sound so bad. That just sucks, Caff; you have my sympathy.

To be clear, your own private renter's insurance said you were SOL on what grounds?

Also, I have an old NES somewhere that I can contribute to the cause. I wouldn't chuck anything though till you've had ample time to dry them out (carts especially) and test to see what is salvageable.

Correct, private renters insurance said 'too bad' based on flood damage, they only cover water damage if its from a burst pipe

I thought the sump pump failed?  Because then there is a mechanical reason your shit is floating, and it's not just an act of God. 

did it actually fail?  Like, no longer working, or could it just not keep up?

It's not really a total fuck my life.. but it sure is a downer...
I have 16 days to finish a 20 minute movie. This includes, sound mixing, color correction, laying in composers music, credits, titles, and effects. I wanted to continue editing today but I can't. I'm so sick.  Sad
